Dams are constructed for economic development, and their construction involves large investments of money, and natural and human resources. Of the various types of dams constructed around the globe, earth dams are the most common type and constitute the vast majority of dams. When adam fails, it culminates in the sudden release of artificially stored water which, in turn, becomes a potential menace to virtually everything downstream. The dam failure may result in loss of life and property. In recent years, instances of dam failure in the world have been too many, and the resulting loss too high. As a result, dam safety pro grams have been developed in most countries of the world since the beginning of the nineteenth eighties. · Earth dams are more susceptible to failure than other types. The cause of failure is often either overtopping or piping. The modeling of dam breaching due to either or both of these causes is of fundamental importance to development of dam-safety programs. This book is, therefore, an attempt to present some aspects of earth-dam breach modeling technology. It is hoped that others will be stimulated to write more comprehensive texts on this subject of growing interest and importance. The book is divided into eight chapters. The first chapter is introductory and discusses some aspects of dams and dam failures in the world.

In 2005, 20 different states and the City of New York followed California's lead and passed laws seeking to require entities collecting or storing personally identifiable information to notify the subjects of the information if that information allows unauthorized third parties access to that information. There are now 21 different state laws on the subject, many with very different requirements. Federal legislation is hoped for, but passage of broadly preemptive federal legislation is far from certain. This book provides comprehensive guidance to all 21 state (and one local) legislative efforts at breach notification statutes, categorizes the various aspects of such statutes and specifically describes how each different state deals with each aspect. It points out the similarities and differences of each state law. The approach is simply a detailed summary of each different legislative scheme.

Accounting for Profit for Breach of Contract

This book defends the view that an award of an account of profits (or 'disgorgement damages') for breach of contract will sometimes be justifiable, and fits within the orthodox principles and cases in contract law. However there is some confusion as to when such an award should be made. The moral bases for disgorgement damages are deterrence and punishment, which shape the remedy in important ways. Courts are also concerned with vindication of the claimant's performance interest, and it is pivotal in these cases that the claimant cannot procure a substitute performance via an award of damages or specific relief. The book argues that disgorgement damages should be available in two categories of case: 'second sale' cases, where the defendant breaches his contract with the claimant to make a more profitable contract with a third party; and 'agency problem' cases, where the defendant promises the claimant he will not do a certain thing, and the claimant finds it difficult to supervise the performance. Moreover, disgorgement may be full or partial, and 'reasonable fee damages' for breach of contract are best understood as partial disgorgement rather than 'restitutionary damages'. Equitable bars to relief should also be adopted in relation to disgorgement damages, as should allowances for skill and effort. This book will be of interest to contract and commercial lawyers, and will be especially valuable to anyone with an interest in contract remedies and restitution. It draws on case law in a number of common law jurisdictions, primarily England and Wales, and Australia.

A look back through the history of women who were about to be married only to be left at the altar—and left with no choice but to take their revenge. A wedding day is supposed to be the happiest, most special and blessed event in a bride’s life. And most of the time, it is. But sometimes, it is not. In this fun, fascinating look at betrothals that went bust before anyone even said “I do,” the authors have collected the true stories of what happened when the groom suddenly decided “I don’t.” From the 1780s right up to the 1970s, jilted women (and the occasional crushed suitor) employed a range of tactics to bring false lovers to book. Here is a full wedding party of cases in which women found very different kinds of happy endings, such as Mary Elizabeth Smith who forged evidence of a courtship to entrap an Earl, Catherine Kempsall who shot the man who denied their engagement, Gladys Knowles who was awarded a record £10,000 in damages by a jury in 1890, and Daisy Mons who discreetly negotiated a £50,000 settlement from a nobleman. Based on original research, this social history of breach of promise shows that when men behaved badly, hell had no fury like a woman scorned.

'The authors of this important book have done a great service to our understanding of this fascinating area of law. Their shrewd and scholarly study traces the development and "myriad reinventions" of this protean doctrine from its eighteen century origins through to its most recent manifestation as a private-facts "tort" in English law, enriching legal analysis with consideration of the philosophical, social and economic contexts. Common law privacy scholars in particular will find that this book directly illuminates contemporary debates.' Gavin Phillipson, University of Durham, UK 'The authors breathe new life into this complex, recondite branch of the law. An illuminating and penetrating study of an ancient remedy whose importance endures and even increases.' Raymond Wacks, University of Hong Kong This concise yet detailed book explores the historical foundations and modern developments of the ancient doctrine of breach of confidence. The authors show that despite its humble beginnings, stilted development and air of quaintness the doctrine has modern relevance and influence, its sense of 'trust and confidence' still resonating with the information society of today. Topical chapters include, 'Inventing an equitable doctrine', 'Privacy and publicity in early Victorian Britain', 'Searching for balance in the employment relationship', as well as many others. Breach of Confidence will make insightful reading for all those interested in issues of privacy and information, and will appeal strongly to practicing lawyers and judges as well as academic researchers and postgraduate law students.

As a young child of twelve, Lou Ann Soontiens saw school as a place of refuge. When the school's resident priest, Father Charles Sylvestre, took an interest in her, she felt honoured and privileged. She put her complete faith and trust in this charismatic man of God and it resulted in years of sexual abuse, humiliation, and an unwanted pregnancy. This misplaced devotion would lead her to forty years of confusion, guilt, and pain and, ultimately, to her being awarded, by the Diocese of London, Ontario, the largest settlement ( 1.75 million Canadian dollars) ever given to an individual by the Catholic Church in Canadian history. It was not until Lou Ann reached middle-age that she found out that she was not alone in her pain and guilt; at least forty-six other women had experienced the same degradation at the hands of Father Charles Sylvestre. Much to her shock, she discovered that the Catholic Church had known about Father Sylvestre's abusive nature, and, as with hundreds of other priests with the same problem, chose to ignore the dangerous situation and quietly move the offending priest to a new parish where the abuse of young children would once again commence.
